US Prosecutors Seize $84M Linked to Unlicensed Money Transmitter

US federal prosecutors have initiated a civil forfeiture of $84.2 million from a payments firm accused of operating an unlicensed money transmission service.

US federal prosecutors have moved to seize approximately $84.2 million from Capstone, a payments company based in Montana. The action, filed in the Eastern District of California, alleges that Capstone operated as an unlicensed money transmitter across at least six states, misrepresenting its true business activities to its banking partners by claiming to be a technology services firm.

The seized assets include roughly $79.11 million from a Wells Fargo Securities account, an additional $1.86 million from a separate Wells Fargo account, and about $2.06 million held at JPMorgan Chase. Notably, the forfeiture also targets just over 1.1 million USDT, a popular stablecoin, held across two cryptocurrency addresses. For retail traders, understanding the regulatory status of payment processors and exchanges is crucial, as issues like these can impact the liquidity and accessibility of funds, particularly when dealing with crypto-to-fiat conversions.

Capstone is reportedly connected to EQIBank, a digital bank licensed in Dominica. Prosecutors suggest that EQIBank utilized Capstone to facilitate US dollar transfers, including transactions related to the buying and selling of USDT. This arrangement reportedly allowed EQIBank to process US dollar transactions through Capstone's banking channels.

Tether's Indirect Involvement

  • Tether, the issuer of the world's largest stablecoin, and its affiliated exchange Bitfinex, were identified as clients of EQIBank.
  • This client relationship has drawn Tether into the broader context of the case, even though Tether itself has not been named as a defendant in the civil forfeiture complaint.
  • Tether has publicly acknowledged its banking relationship with EQIBank.

This development highlights the ongoing scrutiny of payment processors that bridge traditional financial systems with the cryptocurrency ecosystem. The focus remains on compliance with money transmission laws and the transparency of financial operations, especially for entities handling significant volumes of funds.
